Today, I would like to talk about expert witness services provided by my company. I provide declarations and expert witness statements in support of motions, and I am prepared to testify about those declarations and expert witness statements.
Situations requiring these services are when a judge requires an entity to post a bond, where the client cannot do so given their financials, or the bond amount is not economically feasible. One case involved a $1.6 billion judgment entered against the client. I was hired as an expert consultant to provide an expert report on what would be required to obtain the bond and commentary on the financial wherewithal of the applicant. The case itself involved many parties domiciled in various locations and would be referred to as a high-stakes, multi-billion-dollar case. The report was used to support a motion for a stay of enforcement pending appeal, without a bond, which is almost never granted.
I evaluated the complexities of the associated assets and determined that, among other key factors, the bond amount was impossible to obtain. In this report, I worked closely with the law firm and their client to prepare and draft the motion for interim relief. The motion was submitted and granted by the Appellate Division of the New York State Court. My statement was referenced explicitly as one of the reasons the court granted the stay without a bond.
In another case, also in the billion-dollar range, I was hired to go through the individual ins and outs of the bonding process, discuss how much of the bond amount the client could obtain under favorable terms, and why.
In all the cases I’ve worked on, I’ve never been called to testify or deposed. Part of the reason for this is that my reports are comprehensive, and once submitted to the courts, there isn’t much to discuss or push back on. The timelines to prepare these items have been very short, and each time, I’ve produced a succinct report with which clients have been pleased.
